Terms of service

These terms apply to all orders you place as a consumer via heldio.ch with Miraix Creators by M. Rötzer (Allschwil, Switzerland).

The contract is formed when you confirm at checkout ("Order with obligation to pay"). We confirm receipt by email.

We create a personalised children's book based on your input and photos. Depending on the chosen package you receive a PDF and/or a printed book.

All prices are final prices; the prices shown at heldio.ch/en/preise and at checkout apply. The printed book costs €39.99, or CHF 37.90 for delivery to Switzerland. For the printed book, the currency follows the delivery country: deliveries to Switzerland are paid in Swiss francs (CHF), deliveries to every other delivery country in euros (EUR). The digital book costs €14.99 or CHF 14.90, depending on which of the two currencies you choose. Shipping to the delivery countries under section 5 is included in the price.

If you pay in euros, Stripe may offer to charge you in your local currency instead. If you accept, Stripe converts the euro amount and adds a conversion fee (currently about 2–4 %), which is included in the amount shown and paid by you. Paying in euros always remains possible, and then no such fee applies.

No VAT is shown, because the seller is exempt from VAT liability under Art. 10(2) of the Swiss VAT Act (MWSTG). Payment via Stripe using the methods shown at checkout.

We deliver the printed book to the countries listed at heldio.ch/en/preise#lieferlaender (delivery countries). Excluded are areas of a delivery country that are not part of its customs or VAT territory, for example the Canary Islands, Ceuta and Melilla, Åland, Heligoland, Büsingen am Hochrhein, Livigno, Campione d'Italia, Mount Athos, the French overseas territories, Greenland, the Faroe Islands, Jersey, Guernsey, Gibraltar, US territories such as Guam or the US Virgin Islands, and US military post addresses (APO/FPO). We do not deliver to countries that are not listed (such as Liechtenstein, Monaco, Andorra, San Marino or Vatican City), even where their post runs through a neighbouring country. The digital book is available in every country.

Our print partner prints the book at a partner print shop in the delivery country or inside the same customs area and ships it from there straight to the delivery address. The book does not cross a customs border, so no customs duties or import charges arise.

Delivery times shown are non-binding estimates by our print partner, in working days. They start when you release the finished book for printing, or when we release it automatically once the approval period has passed. Your statutory rights in the event of late delivery remain unaffected.

If the delivery address lies outside the delivery countries or in an excluded area, we do not print the book. We will contact you and refund the full amount you paid.

Printed books are made to your specifications, just for you, with your child's name, pictures and text. There is therefore no right of withdrawal for them (for consumers in the EU under Art. 16(c) of Directive 2011/83/EU, in Germany under § 312g(2) no. 1 BGB, in Austria under § 18(1) no. 3 FAGG; Swiss law has no right of withdrawal for online purchases). In return you see exactly what will be printed: after ordering you check the finished book page by page in your account, can still change texts and pictures, and then release it for print. If you do not release it within 3 days of it being ready for you to check in your account, we send it to print automatically so your order does not stall. We tell you the day in advance by email.

The PDF you receive with a printed book is an add-on to that book made just for you. There is no separate right of withdrawal for it.

If you buy only the digital book (PDF), you have a 14-day right of withdrawal (see the withdrawal policy). It expires once you download the file after explicitly agreeing at checkout that we begin performance before the withdrawal period ends and confirming that you thereby lose your right of withdrawal.

If your printed book arrives damaged, trimmed crooked, badly bound or misprinted (for example with streaks, smeared colour, or missing, duplicated or swapped pages), we reprint it at our cost; if a reprint is not possible, we refund the purchase price. Write to hello@heldio.ch within 30 days of delivery, ideally with a photo of the spot. You do not need to send the book back. Content you approved before printing (texts, pictures, the spelling of names) and slight, technically unavoidable colour differences between screen and paper are not printing faults. Your statutory warranty rights remain unaffected.

We are liable without limit for intent and gross negligence and for damages arising from injury to life, body or health. Otherwise our liability is limited to foreseeable, contract-typical damage.

A gift card is valid until the end of the third calendar year after purchase; the exact date is in the confirmation and in the email with the code. It is valid for the package chosen at purchase, in the currency chosen at purchase, and covers that package's current price. The code may be passed on. It cannot be paid out in cash. After it expires, the card can no longer be redeemed.

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident outside Switzerland (in the EU or in any other country), the mandatory consumer-protection rules of your country of residence remain unaffected by this choice of law (in the EU: Art. 6(2) Rome I Regulation). Venue is Basel-Landschaft, unless you as a consumer have a mandatory alternative venue.
